1. Purpose
This Sender Agreement ("Agreement") governs the use of the MonPaké platform by individuals or businesses ("Senders") wishing to arrange the transportation of parcels through Travelers.
MonPaké operates solely as a digital platform that connects Senders with Travelers and does not provide transportation services.
2. Platform Role
MonPaké acts exclusively as an intermediary facilitating connections between Users. MonPaké:
- does not transport parcels
- does not employ Travelers
- does not supervise deliveries
- does not guarantee delivery outcomes
All transportation arrangements are made directly between the Sender and the Traveler.
3. Eligibility
To use MonPaké as a Sender, Users must:
- be at least 18 years old
- provide accurate information
- use a valid phone number
- comply with applicable laws
MonPaké may request identity verification at any time.
4. Creating a Delivery Request
Senders may publish a delivery request ("Listing") on the platform describing:
- pickup location
- destination
- parcel description
- delivery preferences
Senders are responsible for ensuring that all information provided is accurate and complete.
5. Sender Responsibilities
The Sender agrees to:
- provide accurate parcel descriptions
- ensure the parcel is properly packaged
- ensure the parcel is legal to transport
- communicate clearly with the Traveler
The Sender must ensure that the parcel does not contain prohibited items.
6. Prohibited Items
Senders must not request transportation of:
- illegal goods
- weapons
- drugs or controlled substances
- hazardous materials
- stolen items
- any item prohibited by law
MonPaké reserves the right to suspend accounts associated with illegal activities.
7. Parcel Packaging
The Sender is responsible for packaging parcels safely and securely. MonPake is not responsible for damages resulting from:
- inadequate packaging
- fragile items improperly protected
- undisclosed parcel contents
8. Payment Terms
Payment conditions are agreed directly between the Sender and the Traveler unless otherwise specified by the platform.
MonPaké may introduce:
- service fees
- commissions
- payment processing features
MonPaké is not responsible for disputes regarding payments between Users.
9. Delivery Risks
The Sender acknowledges that transportation is performed by independent Travelers. As such, MonPaké does not guarantee:
- delivery times
- parcel condition
- delivery completion
Senders assume the risks associated with peer-to-peer delivery arrangements.
10. Ratings and Reviews
After each delivery, Senders may rate Travelers and leave feedback. These reviews help maintain trust and transparency within the platform. MonPake may remove abusive or fraudulent reviews.
11. Communication
Senders agree to communicate respectfully with Travelers. Senders must not:
- harass other Users
- share misleading information
- attempt to bypass the platform's matching system
12. Disputes
In the event of a dispute between a Sender and a Traveler, MonPake may:
- review relevant information
- facilitate communication between Users
- propose a resolution
However, MonPake is not obligated to provide compensation.
13. Limitation of Liability
To the fullest extent permitted by law, MonPaké shall not be liable for:
- parcel loss
- parcel damage
- delivery delays
- Traveler misconduct
- financial losses resulting from deliveries
MonPaké acts solely as a technology platform connecting Users.
14. Indemnification
The Sender agrees to indemnify and hold harmless MonPaké and its operators from any claims, damages, or liabilities arising from:
- unlawful parcel contents
- inaccurate information
- violations of this Agreement
- disputes with Travelers
15. Account Suspension
MonPaké may suspend or terminate accounts that:
- violate these terms
- engage in fraudulent activity
- attempt to misuse the platform
Such actions may be taken without prior notice when necessary.
16. Changes to the Agreement
MonPaké may update this Agreement at any time.
Continued use of the platform constitutes acceptance of the updated terms.
17. Governing Law
This Agreement is governed by the laws of the Democratic Republic of Congo. Any disputes shall fall under the jurisdiction of the competent courts of Kinshasa.
