1. Introduction
Welcome to MonPaké.
These Terms of Service ("Terms") govern your access to and use of the MonPaké platform, including the website, mobile application, and related services (collectively, the "Platform").
By accessing or using the Platform, you agree to comply with these Terms. If you do not agree with these Terms, you must not use the Platform.
2. Description of the Service
MonPaké provides a digital platform that enables individuals and businesses ("Senders") to connect with individuals ("Travelers") willing to transport parcels during trips they are already undertaking.
MonPaké does not provide transportation services. MonPaké:
- does not operate as a carrier
- does not control the actions of Users
- does not take possession of parcels
- does not guarantee delivery outcomes
All transportation arrangements are made directly between Users.
3. Eligibility
To use the Platform, you must:
- be at least 18 years old
- provide accurate information
- use a valid phone number
- comply with applicable laws
MonPaké may request identity verification at any time.
4. User Accounts
To access certain features of the Platform, Users must create an account. Users agree to:
- provide accurate information
- maintain the security of their account
- promptly update any inaccurate information
Users are responsible for all activities conducted under their accounts.
5. User Roles
The Platform may be used by:

6. Platform Rules
Users agree not to:
- engage in fraudulent activity
- misuse the Platform
- impersonate another person
- share illegal content
- attempt to bypass the Platform's matching system
Violation of these rules may result in suspension or termination of accounts.
7. Prohibited Activities
Users must not use the Platform to:
- transport illegal goods
- distribute controlled substances
- transport weapons or dangerous materials
- engage in unlawful activities
MonPaké reserves the right to suspend or terminate accounts involved in prohibited activities.
8. Payments
Payment terms are agreed directly between Senders and Travelers unless otherwise specified.
MonPaké may introduce:
- service fees
- commissions
- payment processing features
MonPaké is not responsible for payment disputes between Users.
9. Ratings and Reviews
Users may leave ratings or reviews following deliveries. These reviews help maintain trust and transparency.
MonPaké may remove:
- fraudulent reviews
- abusive comments
- manipulated ratings
10. Monitoring and Communications
MonPaké may monitor communications exchanged through the Platform for purposes such as:
- fraud prevention
- dispute resolution
- maintaining platform integrity
MonPaké may restrict communications attempting to circumvent the Platform.
11. Intellectual Property
All content on the Platform, including logos, software, and design elements, is the property of MonPaké or its licensors.
Users may not reproduce, distribute, or modify Platform content without permission.
12. Privacy
User data is processed in accordance with the MonPaké Privacy Policy.
By using the Platform, Users consent to the processing of personal data as described in that policy.
13. Limitation of Liability
To the maximum extent permitted by law, MonPaké shall not be liable for:
- parcel loss or damage
- delivery delays
- actions of Users
- financial losses arising from transactions between Users
MonPaké operates solely as a technology platform connecting Users.
14. Indemnification
Users agree to indemnify and hold harmless MonPaké and its operators from any claims, damages, or expenses arising from:
- violations of these Terms
- unlawful activities
- disputes with other Users
15. Suspension and Termination
MonPaké may suspend or terminate accounts for:
- violations of these Terms
- fraudulent behavior
- safety concerns
Such actions may occur without prior notice when necessary to protect the Platform.
16. Service Availability
MonPaké does not guarantee uninterrupted access to the Platform. The Platform may be modified, suspended, or discontinued at any time.
17. Force Majeure
MonPaké shall not be responsible for service disruptions caused by events beyond its control, including:
- natural disasters
- telecommunications failures
- internet outages
- government actions
18. Modifications to the Terms
MonPaké reserves the right to modify these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.
19. Governing Law
These Terms are governed by the laws of the Democratic Republic of Congo.
Any disputes shall fall under the jurisdiction of the competent courts of Kinshasa.
