1. Purpose
This Agreement defines the conditions under which a Traveler uses the MonPaké platform to transport parcels on behalf of Senders. MonPaké operates solely as a digital marketplace connecting Users and is not a transport company.
2. Traveler Status
The Traveler expressly acknowledges that:
- They act as an independent user.
- They are neither an employee nor a representative of MonPaké.
- They use the platform within the context of trips they are already making.
- They are solely responsible for their own activities.
3. Acceptance of Deliveries
The Traveler is free to:
- Accept or refuse any delivery request.
- Agree on delivery conditions directly with the Sender.
Once a delivery is accepted, the Traveler agrees to:
- Carry out the agreed transport.
- Respect reasonable delivery timeframes.
- Maintain communication with the Sender.
4. Responsibility
The Traveler is responsible for the parcel from the moment it is collected until it is delivered to the intended recipient. In case of loss, theft, or damage, the Traveler may be held responsible toward the Sender.
5. Prohibited Items
The Traveler agrees not to transport:
- Illegal goods
- Weapons or dangerous items
- Prohibited substances
- Stolen property
If there is any doubt about the content of a parcel, the Traveler must refuse the delivery.
6. Parcel Verification
The Traveler is encouraged, where reasonably possible, to verify the parcel's contents and to refuse any suspicious shipment. MonPaké cannot be held responsible for the contents of parcels transported through the platform.
7. Payment
Payment terms are agreed directly between the Sender and the Traveler. MonPaké may charge a service commission on certain transactions.
8. User Conduct
The Traveler agrees to:
- Respect other users.
- Not commit fraud on the platform.
- Not attempt to bypass the platform's matching system.
Any abusive or fraudulent behavior may result in suspension or termination of the account.
9. Ratings and Reviews
After each delivery, Senders may leave a review and Travelers may also rate the experience. These evaluations contribute to transparency and trust within the platform.
10. Suspension or Termination
MonPaké may suspend or permanently remove a user account in cases of fraud, dangerous behavior, or violation of this Agreement.
11. Limitation of Liability
MonPaké is not responsible for incidents occurring during transportation, disputes between users, or financial losses. However, MonPaké may act as a mediator to help resolve disputes when possible.
12. Modification
MonPaké reserves the right to modify this Agreement at any time. Continued use of the platform constitutes acceptance of the updated terms.
13. Governing Law
This Agreement is governed by the laws of the Democratic Republic of Congo. Any disputes fall under the jurisdiction of the competent courts of Kinshasa.
